Please read these terms carefully before using this website. By using this website you agree to be bound by these terms and conditions. If you DO NOT ACCEPT such terms and conditions, do not use this website!



These GENERAL TERMS and CONDITIONS regulate the relationships between "BIKE RETAIL" EOOD, on the one hand, and the Users of electronic (Internet) pages and services located on the domain www.bikesport.bg and its subdomains (hereinafter referred to as the "Site"), as well as the relationships with the same when they use the information and commercial services, offered by "BIKE RETAIL" EOOD (hereinafter referred to as the "Service/s") on the Site. In order to be able to use the Services of www.bikesport.bg, the User registers on the Site and thus he/she agrees, fully accepts and undertakes to comply with these General Terms and Conditions.



These terms are binding on all users. By clicking on any object, link or button located on the pages of www.bikesport.bg, the User agrees, fully accepts and undertakes to comply with these General Terms and Conditions.

1. Terms of use of the Site www.bikesport.bg ("BIKE RETAIL" EOOD)



By registering on the Site, the User confirms and declares his/her agreement with the following:



The information services on the Site are provided "as published".



The on-line system for purchases through the Site reflects the availability of items at the time of the inspection, given the dynamics of trade, certain items and accessories may be published on the Site as "available" in the company's stores at the time of inspection, to be exhausted on request and not to be ordered and delivered through the online store. In any case, "BIKE RETAIL" EOOD confirms the possibility / impossibility of delivery of the goods ordered through the On-line system.



It is possible for the parameters (term/method of delivery, etc.) of an order made through the On-line system to be changed and "BIKE RETAIL" EOOD is obliged to notify the User of the changes made to the e-mail and/or contact telephone provided by him/her and/or in another appropriate way no later than the time of sending the User the message for delivery of the confirmed order to the address of the User. The order with changed parameters will be completed only subject to the consent given by the User.



The User agrees to receive information through the provided contact methods for products and services of "BIKE RETAIL" EOOD and in case he/she does not want to receive such information the User should explicitly refuse to receive the same through the inquiry and contact forms on the Site.



2. Obligations of the User upon registration



When registering on the Site the User provides true, accurate, up-to-date and complete information necessary for the sale by filling in all mandatory fields of the registration form and undertakes to make changes to such personal data if necessary in order to ensure they are true, accurate, up-to-date and complete.



"BIKE RETAIL" EOOD is not responsible for incorrectly and/or inaccurately executed orders in case the User provides false, inaccurate, out-of-date or incomplete information, and also has the right to refuse to give the person further access to part or all of the services, offered on the Site.



In view of the security and protection of the privacy of its Users, www.bikesport.bg informs parents that the materials and services are made available to the widest audience and that they are responsible for determining the appropriate services and materials to be used by their children.



3. Protection of personal data. Confidentiality policy of www.bikesport.bg



Pursuant to the Personal Data Protection Act, the User has the right to access his/her own Personal Data, which he/she has entered or has provided to www.bikesport.bg during his/her use of the Site, as well as the right to rectify such Personal Data.



By accepting these terms and conditions, Users who have registered a username and password expressly agree that the Personal Data provided by them (including the selected username and password) will be processed by www.bikesport.bg electronically upon delivery of ordered goods or services and in case customer support by an employee of www.bikesport.bg is needed.



All Personal Data voluntarily provided by the User and other Data that identify him/her in the process of using the Site are stored, processed and used by www.bikesport.bg for the purposes of maintaining certain functionalities of the services offered and for the purposes of advertising goods and services.



www.bikesport.bg expressly informs the User that the Personal Data provided by the User are not given to third parties for advertising and promotional purposes.


www.bikesport.bg reserves the right to use the IP addresses and other data of the Users to reveal their identity where this is necessary in the implementation of the law, legal procedures or to comply with these terms and conditions.



"BIKE RETAIL" EOOD informs Users that it is registered as a data controller in the Register of Data Controllers at the Commission for Personal Data Protection with identification number 351752. Your personal data will be used by "BIKE RETAIL" EOOD for the purpose for which they were provided to it, and will not be disclosed to any third parties or further processed in a manner incompatible with this purpose, except in the cases provided for in a legal regulation. By accepting these General Terms and Conditions, you consent to "BIKE RETAIL" EOOD storing and processes your personal data.



4. Access, username and password, security



The User receives the desired username (in case it is not used by an already registered user) and password for access to all services of www.bikesport.bg after completing the registration process.



The User is responsible for maintaining the confidentiality of the username and password received. By using them, he/she declares that he/she is personally and on his/her own behalf fully responsible for all activities accessed with his/her username and password.



The User agrees to immediately notify www.bikesport.bg of any unauthorized use of his/her username and password and/or of any other breach of security.



In case of losing (forgetting) the password and an explicit request by the User, www.bikesport.bg will send an e-mail message containing the registered username and password to the e-mail address provided by the User during the registration process.



www.bikesport.bg is not responsible for any damages and losses incurred due to non-compliance with the provisions of this section.



5. User Conduct



Users of the Site understand that the information, data, published opinions, text, software, music, sound, photos or any other materials (collectively hereinafter referred to as "Content") that become publicly available or are transmitted in confidence are the sole responsibility of the person who generated this Content.



The User of the Site is fully responsible for the Content posted or otherwise transmitted, provided by the Site.



When using the Site, the User may encounter Content that is offensive, indecent or unacceptable in nature. Under no circumstances will www.bikesport.bg be responsible for any Content created by Users, including errors and omissions in it and/or for any damages and losses of any nature arising as a result of using Content displayed, posted, submitted or otherwise transmitted through the Site.



www.bikesport.bg reserves the right to limit and/or deny access to the Site for Users who once or systematically violate the law.



www.bikesport.bg reserves the right to edit and remove information provided by the User in violation of the law.



6. Copyright and related restrictions.



Users may use all services offered on the Site for personal, non-profit purposes and provided that the copyrights of "BIKE RETAIL" EOOD or third parties related directly or indirectly to the materials on the Site are not violated. The materials on this Site should not be modified in any way, nor copied, publicly distributed or given away for any public or commercial purposes. The use of materials published on this Internet Site on other sites is prohibited.



"BIKE RETAIL" EOOD reserves the right to assign the rights to publish materials and other information published on the Site to third parties under an additional agreement governing the legal relations between "BIKE RETAIL" EOOD and the person publishing the information.



Links on the Site to other third parties' sites are posted for the convenience of users. When using such a reference, users are not using a service provided by "BIKE RETAIL" EOOD and these General Terms and Conditions do not apply with regard to the use of the reference outside the Site.



"BIKE RETAIL" EOOD is not responsible for the information and/or content of other sites owned by third parties. "BIKE RETAIL" EOOD does not in any way force the users to use these sites or recommend them to users, nor the information published on them. Visiting such sites and the risks associated therewith is at the sole responsibility and risk of the User.



7. Goods and services provided on the Site.



The information about the goods on the Site is distributed by types of groups and subgroups.



On the page (link) to each item listed on the Site, information is provided regarding the price, the main characteristics of the product and additional information aimed at helping Users make an informed choice when purchasing the product;



All prices on the site are in the selected currency, GBP, BGN, USD or EUR and are VAT included. In case the item have several modifications, the price for each of the modifications is indicated on the page. "BIKE RETAIL" EOOD has the right at any time and without warning to make changes to the published products, services, prices and other characteristics of the goods and the Users are considered informed of the specified changes from the date of their publication. The information for some of the published products may not have been updated, but in any case the Users will be notified when placing an order on the Site by using a form for on-line purchases before their delivery that the information on the Site related to the ordered products is not up-to-date, and the order will be delivered only subject to consent expressed by the User.




8. Purchase of goods and/or services from the Site www.bikesport.bg



The User has the right to order all goods and services displayed on the Site www.bikesport.bg. When making an order the User has the right to choose the type, brand and model of the goods, their quantity, the payment conditions, the way and terms of delivery according to the options offered on the Site.



At any time before the final confirmation of the order by filling in the form for on-line purchases, the User has the right to make changes in the goods and services selected by him/her.



When placing an order on the Site www.bikesport.bg the User enters into contractual relations with "BIKE RETAIL" EOOD for purchase and sale of the selected item, regulated by these General Terms and Conditions, and the order is considered approved after receiving confirmation from "BIKE RETAIL" EOOD, containing all the above parameters and according to the instructions provided on the Site.



The contract between the User and "BIKE RETAIL" EOOD enters into force after a telephone conversation between the User and an employee of "BIKE RETAIL" EOOD during which the User confirms his/her desire to purchase the ordered goods.



"BIKE RETAIL" EOOD has the right to change the prices indicated on the Site at its discretion, at any time and without being obliged to notify the Users in advance. The User is obliged to pay the price that was indicated on the Site at the time of order placing, regardless of whether it is lower or higher than the updated price.



In case of technical errors in the information published on the Site, as a result of which the order cannot be executed, "BIKE RETAIL" EOOD has the right to refuse the execution of the order and does not owe any compensation to the User, except refund of amounts paid and/or deposited by the User for the cancelled order, if any.



The delivery is performed based on the information - first name, last name and delivery address specified by the customer in the profile created on the Site.



"BIKE RETAIL" EOOD and the User agree that all statements between them in connection with the conclusion and execution of the sale and purchase contract can be made electronically and through electronic statements within the meaning of the Electronic Document and Electronic Signature Act and the Electronic Commerce Act. It is assumed that the electronic statements made by the Users are made by the persons indicated in the information, provided by the User during registration, if the User has entered the corresponding name and password for access.



9. Payment for purchased goods and services.



When paying by bank transfer, the User pays an amount equal to the value of the delivered goods, according to the confirmed order, to the bank account of "BIKE RETAIL" EOOD, stated in the generated invoice and only after the payment is confirmed as received and the bank account is verified with the corresponding amount, "BIKE RETAIL" EOOD performs the delivery of the ordered goods and/or services.



When paying by credit/debit card, the User pays an amount equal to the value of the delivered goods, according to the confirmed order. After the payment transaction is confirmed, "BIKE RETAIL" EOOD executes the delivery of the ordered goods and/or services.



When paying through a PayPal account, the User pays an amount equal to the value of the delivered goods, according to a confirmed order, through a PayPal account and only after the payment transaction is confirmed, "BIKE RETAIL" EOOD executes the delivery of the ordered goods and/or services.



When paying by cash on delivery, the User pays the delivery service delivering the ordered goods an amount equal to the value of the delivered goods, according to the confirmed order, after which the delivery service delivers the ordered goods and/or services.

Online hire purchase with a loan granted by a financial institution

Only a User whose specific online order amounts to (excluding the cost of delivery) or exceeds BGN 150 (one hundred and fifty Bulgarian levs) has the right to apply for a loan. he specific conditions for applying for and granting a loan are determined unilaterally by the respective bank or financial institution, in accordance with its loan policy. The company is not involved in any way in the relationships between the User and the lending institution. The granting of loans is made in accordance with the rules and requirements of the lender and has nothing to do with the company. We advise the User to make a careful and informed choice of the lending institution and to familiarize himself/herself in advance with the commitments he/she will undertake. The User will be notified by phone by the lending institution of the conditions and the actions to be taken. The ordered items will be delivered only after the company receives confirmation from the lender that the User has been approved for loan granting for the online hire purchase of goods.




10. Delivery of purchased goods.



Delivery of ordered goods is completed within 5 /five/ days from the date of order confirmation by a phone call from an employee of "BIKE RETAIL" EOOD. The phone call is made within 2 days from the approval of the order made by its confirmation by "BIKE RETAIL" EOOD.



"BIKE RETAIL" EOOD reserves the right to extend the specified terms by up to 7 (seven) days without informing the Users in advance, and to extend the terms by more than 7 (seven) days with the prior consent of the User who requested the delivery.


The delivery of ordered bicycles is made FREE of charge on the territory of the Republic of Bulgaria.

For orders up to BGN 99.99 including VAT, a delivery service fee of BGN 10, VAT included is charged.

The price for delivery of ordered bicycles, accessories and components outside the territory of the Republic of Bulgaria is calculated for each specific order based on the type of product, weight, volume and delivery address.


"BIKE RETAIL" EOOD requires additional confirmation from the User on the phone specified by the User for the order placed. In the event that the User refuses to provide the information requested by "BIKE RETAIL" EOOD, "BIKE RETAIL" EOOD, at its discretion, may cancel the order and will notify the User thereof. If incorrect or false address, contact person and/or phone number are specified when submitting the request, "BIKE RETAIL" EOOD is not responsible for inaccurate execution of the order as a result of incorrect information submitted by the User.



"BIKE RETAIL" EOOD has no obligation to install/assemble the delivered goods.



Upon delivery, the goods should be carefully inspected by the User and/or a person authorized by him/her. In the event that external visible defects - possible damages, impacts and other damages are found upon delivery, the User should sign a damage report in the presence of the courier, in which he/she should describe the defects found and immediately notify "BIKE RETAIL" EOOD on contact phone +359 32 921 911, e-mail address: firmenmagazin@maxcombike.com thereof. In the event that a damage report is not prepared and signed in the presence of the courier upon receipt of the goods, "BIKE RETAIL" EOOD will consider that no external visible defects of the goods - possible damages, impacts and other damages were found.



Any non-conformity of the consumer goods with the sale contract which becomes apparent within 6 months after the delivery of the goods shall be deemed to have existed at the time of delivery, unless it is proved that the lack of conformity is due to the nature of the goods or the nature of the discrepancy.



The User may not dispute the conformity of the consumer goods with the contract for its sale, when: at the conclusion of the contract he/she knew or could not have been unaware of the non-conformity; the discrepancy is due to materials, supplied by the User.



When the goods are handed over the User or a third party nominated by him/her must sign the accompanying documents. A third party is considered any person who has not made the order request himself/herself but is to accept the goods upon delivery to the delivery address specified by the User.



Where the User is not present at the address stated by him/her within the delivery period and/or no access is provided to the delivery address, "BIKE RETAIL" EOOD is released from its obligation to deliver the requested goods and the User may lose the opportunity to have the goods ordered by him/her delivered. In this case "BIKE RETAIL" EOOD will not be responsible for the goods/services not delivered.



Where there is a clear discrepancy between the goods delivered and the goods ordered for purchase by the User, and this can be established upon normal visual inspection of the goods delivered, the User has the right to request the replacement of the goods delivered by goods corresponding to the ones ordered for purchase within 7 (seven) days of informing "BIKE RETAIL" EOOD thereof on tel. number +359 32 921 911 or e-mail: firmenmagazin@maxcombike.com.



"BIKE RETAIL" EOOD reserves the right to choose/change the subcontractor executing the delivery without the obligation to inform the User therefor in advance, as long as this does not result in any changes of the method and terms of delivery.



11 . Refusal of purchased goods.



The User has the right to withdraw from the distance contract or from the off-premises contract without giving a reason therefor, without owing compensation or penalty, within 30 days, starting from the date on which the User or a third party nominated by the User, accept the item(s).



In order for the period for withdrawal from the contract to be observed, it is sufficient for the User to send his/her message regarding the exercise of the right of withdrawal before the expiry of the 30-day period, deemed as from the date on which the User or a third party nominated by the User accepts the product/s.



In order to exercise his/her right of withdrawal, the User should notify "BIKE RETAIL" EOOD of his/her name, geographic address and, if any, telephone number, fax and e-mail address, and of his/her decision to withdraw from the contract by an unequivocal statement, and for convenience, "BIKE RETAIL" EOOD provides the User immediately after the General Terms and Conditions with the standard form for exercising the right of withdrawal in compliance with Annex No. 6 to the Consumer Protection Act (CPA), which should be duly completed by the User and sent to "BIKE RETAIL" EOOD by post, fax or e-mail. The use of the standard form- Annex No. 6 is optional.



The User can also fill in and submit electronically an unequivocal withdrawal request to the e-mail address firmenmagazin@maxcombike.com, and in such case "BIKE RETAIL" EOOD will immediately send on a durable medium ( e.g. by e-mail) an acknowledgement of receipt of such a withdrawal.



For the purpose of observing the deadline for withdrawal from the contract, it is sufficient for the User to send his/her communication for exercising the right of withdrawal before the expiry of the period for withdrawal from the contract.



If the User withdraws from the contract "BIKE RETAIL" EOOD will refund the payments received from the User without undue delay and in any case no later than 14 days from the date on which it was notified of the user's decision to withdraw from the contract. The direct costs of returning the goods are expected not to exceed approximately BGN 20 for each individual item, they are paid by the User and are deducted from the payments made by the User. "BIKE RETAIL" EOOD will make the refund only to the client's bank or card account, and by accepting these General Terms and Conditions, the User gives his/her express consent to use those means of payment. By virtue of these General Terms and Conditions, the User is considered informed and agrees to pay the costs of returning the goods upon refusal of the purchased goods.



The User should return the goods to "BIKE RETAIL" EOOD without undue delay and in any case no later than 14 days after the day on which the User informed "BIKE RETAIL" EOOD of his/her withdrawal from the contract. The period of return is considered met if the User returns the goods to "BIKE RETAIL" EOOD before the expiration of the 14-day period from the day on which the User informed "BIKE RETAIL" EOOD of his/her withdrawal from the contract.



"BIKE RETAIL" EOOD has the right to postpone the refund of the User's payments until the goods are received back or until evidence is presented by the User that he/she returned the goods, whichever of the two events occurred earlier.



Circumstances in which the User loses his/her right to withdraw from the contract: the item must be returned in its original packaging in its entirety, complete with the accompanying documentation and undamaged. "BIKE RETAIL" EOOD reserves the right, in case the returned goods have damaged packaging, traces of use, scratches, bumps, their accessories and warranty card are missing, to assess whether the User loses his/her right of withdrawal, respectively whether to accept the returned goods.



12. Warranty service.



"BIKE RETAIL" EOOD is responsible for any non-conformity of the consumer goods with the sale contract which exists at the time of delivery of the goods and occurs up to two years after its delivery, even if it was not aware of the non-conformity. In case of online registration of the product on the Site www.bikesport.bg, the warranty period of the frame and fork (if they are fitted from the outset by "BIKE RETAIL" EOOD ) will be extended to three years.



"BIKE RETAIL" EOOD informs all Users that they have a statutory warranty for the goods purchased by them, provided for in the Consumer Protection Act (CPA).



A commercial warranty is any obligation assumed by the trader or the manufacturer to the consumer in addition to their obligation under this law to ensure compliance of the goods with the sale contract, to refund the amount paid or to replace or repair the goods, or to provide other services, related to the goods, when they do not meet the specifications or possibly other requirements not related to the conformity of the goods with the sale contract, specified in the application for a commercial warranty or in the relevant advertisement made at the time of conclusion or before the contract.



The application for the provision of a commercial warranty must contain information on:



1. consumer rights arising from the warranty under Art. 112 – 115 of the CPA which clearly states that the commercial warranty does not affect the rights of consumers arising from the warranty under Art. 112 – 115 of the CPA, and more precisely, that regardless of the commercial warranty, the seller is responsible for the non-compliance of the consumer goods with the sales contract under the warranty under Art. 112 – 115 of the CPA;



2. the content and scope of the commercial warranty;



3. the essential elements necessary for its implementation, and in particular: the ways of submitting complaints; commercial warranty period; territorial scope of the commercial warranty; name and address of the person providing the commercial warranty and name and address of the person to whom the commercial warranty can be submitted, when that person is different from the person providing the commercial warranty.



With each delivery of goods subject to warranty service, "BIKE RETAIL" EOOD issues and provides the User with an appropriate warranty card, containing the product details and warranty periods, as well as the conditions of the provided commercial warranty.



The User cannot invoke and loses his/her rights under the provided commercial warranty:



(a) in the event of a lost warranty card;

(b) in case of an attempt to carry out repairs and eliminate non-compliance by a person or service centre not authorized by "BIKE RETAIL" EOOD;

(c) in the event of damage caused by improper operation;

(d) in the event of a breach of the physical integrity of the product;

(e) in the event of chemical, electrical and/or other effects not related to the normal operation of the product;



The warranty does not cover:

(a) rented out products;

(b) racing bicycles, bicycles intended for tests and demonstrations (demo bicycles);

(c) bicycles not completely assembled;

(d) damages caused by - accidents, negligence, improper treatment, misuse, improper use, improper assembly;

(e) damages caused by – non-compliance with the recommended conditions for maintenance and use;

(f) damage caused by - incorrect or improper maintenance or repairs carried out by anyone other than an official Bikesport representative;

(g) damages that occurred - due to the use of parts and accessories inconsistent with the Product and the modification of the Product.



The commercial warranty provided for the product does not cover product components with a limited shelf life:



(a) tires (inner tubes and tyres);

(b) brake linings;

(c) V brake/brake pads;

(d) cores, capsules (metal, plastic);

(e) pedals;

(f) handlebar grips;

(g) chain;

(h) headlights;

(i) water bottle.



The warranty service is performed only in the service centres listed on the warranty card subject to the presentation of complete documentation and equipment.



Products and services mentioned on this Site are limited to the General Terms and Conditions and information listed on the Site without provision of any warranties, other than those listed, including commercial and targeted.



"BIKE RETAIL" EOOD explicitly inform the Users that the commercial warranty does not affect the rights of users, arising from the warranty under Art. 112-115 of the Consumer Protection Act. Regardless of the commercial warranty the Seller is responsible in case of lack of conformity of consumer goods with sales contract under the warranty under Art. 112-115 of the CPA. The User has the rights stipulated in Section III of Chapter 5 of the Consumer Protection Act. Regardless of the provided product commercial warranty, the User has the right to submit a claim for the product or service.



13. Miscellaneous.



"BIKE RETAIL" EOOD is the administrator of this Site ( www.bikesport.bg). "BIKE RETAIL" EOOD reserves its right to send to the User notifications for new products and services, promotions and/or changes of the terms and modes of delivery of the goods offered, as well as any other information which is not published on the website.



Questions, inquiries and consultations may be made online through the website of "BIKE RETAIL" EOOD by using the inquiry form or by contacting a sales assistant at +359 32 921 911, e-mail address: firmenmagazin@maxcombike.com com or through the chat application on the website within the working hours: 8:30 a.m. - 5.15 p.m., from Monday to Friday.



These General Terms and Conditions can be modified by "BIKE RETAIL" EOOD, of which the latter shall properly inform all registered Users of the E-SHOP www.bikesport.bg.



"BIKE RETAIL" EOOD and the User agree that any supplement and amendment of these General terms and conditions shall have an effect on the Registered User after he/she is explicitly informed thereof by "BIKE RETAIL" EOOD and unless the User declares within 30 days that he/she disagrees with them.



The User agrees that any statements made by "BIKE RETAIL" EOOD on the amendment of these general terms and conditions shall be sent to the e-mail address stated by the User upon his/her signing up. The User agrees that emails sent under this Article do not have to be signed with a digital signature, in order to have effect in respect of him/her.



When using the Site www.bikesport.bg the Users undertake to comply with the present General Terms and Conditions, as well as with the legislation of the Republic of Bulgaria applicable to the goods and services offered on the Site, including with the provisions of the international legislation.
